Abstract


The tripartite separation of prosecution, defense, and adjudication in modern judicial systems is typically explained as "checks and balances" — preventing any single party from abusing power. This paper provides a deeper explanation from the structural cognition framework: tripartite separation is not checks and balances; it is structural completeness. Binary inter-reference (prosecution and defense) inevitably produces blind spots shared by both parties. The adjudicator does not participate in the content debate between prosecution and defense but occupies the blind-spot observation position — detecting the blind spots of the prosecution-defense inter-reference process. The structural functions of the three parties are: the prosecution proposes the initial configuration (A position), the defense inter-refers with the prosecution's configuration (B position), and the adjudicator detects the blind spots of the prosecution-defense inter-reference process (C position). This is not "three heads are better than one" — the function of the C position is determined by structural position, not by the number of people. Adding more parties (multiple plaintiffs, multiple defendants, multiple judges) not only fails to increase completeness but introduces redundant nodes in the same structural position, causing inter-reference chain bifurcation, C-position overload, and structural collapse. This paper provides the completeness proof of the courtroom's triadic structure, the destructive analysis of multi-party redundancy, the recursive explanation of the two-tier appellate system, the nested layering of jury and judge, and three testable predictions.
